WHAT IS A DEPOSITION?

A deposition is a formal statement made under oath by a witness or party in a legal case, typically recorded for use in court proceedings. It is a critical part of the discovery process in civil and criminal litigation. During a deposition, a witness answers questions posed by an attorney, and the testimony is preserved through audio, video, or written transcript.

HOW NOTARIZATION PROCESS WORKS?
The notary verifies the identity of the deponent using a valid photo ID, ensures that the deponent is willing to provide testimony and understands the legal significance of doing so under oath, and then administers the oath or affirmation before the deposition begins.
IDENTITY VERIFICATION
Deponent must present a valid government-issued photo ID. Proof of signing authority may also be required.
ADMINISTERING OATH
Notary will administer the oath and deponent must understand that their testimony may be used as an evidence in a legal proceeding.
EXECUTION AND NOTARIZATION
The document is signed in the presence of the notary. The notary completes the certificate and applies their official stamp.

THE ROLE OF A NOTARY PUBLIC IN A DEPOSITIONS

In Illinois, a notary public may assist in the deposition process by:


  • Administering the oath or affirmation to the deponent (the person giving the testimony)
  • Verifying the deponent’s identity using acceptable identification methods
  • Certifying that the testimony was taken under oath
  • Completing a deposition certificate or jurat
  • Serving as an impartial officer - not representing either party involved in the dispute

A notary may also serve as a notarial officer for written interrogatories and written depositions, especially when in-person testimony is not required.
